Can I rebuild my credit if I file for bankruptcy?
Yes, it is possible to repair your credit after bankruptcy with a structured approach. Create a budget. Check your credit reports often to make sure they are accurate. Make your payments on time; even one late payment can hurt. Rebuilding credit takes time and patience. Consistent, positive financial behavior will improve your credit score.
If I file for bankruptcy, can I still get credit (mortgage, credit cards, etc.)?
It is still possible to get credit in the future. Secured credit cards and credit-builder loans can help. If you file Chapter 13, you could get an FHA loan in as soon as one year, as long as you have made your payments and have court approval. With a Chapter 7, it can be as soon as 2 years. With time and work, you can regain your credit.
Will I lose my home if I file for bankruptcy?
It depends on your situation, and the type of bankruptcy you file. Florida’s bankruptcy exemption is extremely generous; provided you meet residency and ownership requirements you can exempt an unlimited amount of equity in your home. The Florida Homestead Exemption can protect you from most creditor claims and may allow you to keep your home.
I just moved to Florida. Do I need to update my Will?
Each state has different laws regarding wills, so your old will may not comply with Florida laws; this could cause problems during probate. If you've acquired new assets, you should update your will to ensure they are included. Also, since Florida requires executors to be either a resident or a close relative, you may need to appoint a new one.
What can an attorney do to stop creditor harassment?
An attorney can help you understand what creditors can and cannot do to collect a debt. A cease-and-desist letter can stop creditors contacting you. He can negotiate with creditors to reduce the amount you owe. He can communicate with creditors for you, reducing the stress and anxiety. When needed, he can take legal action to protect your rights.
